1427. It was reported from Hammad, from Hishām bin ‘Amr Al-Fazārī, from ‘Abdur-Raḥmān bin Al-Ḥārith bin Hishām, from ‘Alī bin Abī Tālib that the Messenger of Allāh ﷺ would say at the end of his Witr: “Allāhumma! Innī A’ūduhu bi-riḍākā min sakhaṭikā wa bi-mu'āfātika min 'uqūbatika, waa'ūdhu bika minka lā uḥṣī thanā'an'alaikā, anta kamā athnaita 'alānafsik (O Allāh! I seek refuge inYour pleasure from Yourdispleasure, and from Yourprotection against Yourpunishment, and I seek refuge inYou from You. I cannot count (dojustice in) praising You, for Youare as You have praisedYourself).” (Ṣaḥīḥ) Abū Dāwūd said: Hishām is theearliest of Hammād's Shaikhs, andit was conveyed to me from Yahyābin Ma'in that he said: “No oneother than Hammād bin Salamahreports from him.” Abū Dāwūd said: 'Eisā bin Yūnusreported from Sa'eed bin Abī'Arūbah, from Qatādah, fromSa'eed bin 'Abdur-Raḥmān binAbzā, from his father from Ubayybin Ka'b, that the Messenger ofAllāh ﷺ would perform the Qunūt— meaning in the Witr prayer —before going into Rukū'. Abū Dāwūd said: And 'Eisā binYunūs also reported this Ḥadīthfrom Fiṭr bin Khalifah, fromZubaid, from Sa'eed bin 'Abdur-Raḥmān bin Abzā, from his fatherfrom Ubayy, from the Prophet ﷺsimilarly. And it has been relatedfrom Ḥafṣ bin Ghiyāth fromMis'ar, from Zubaid, from Sa'eedbin 'Abdur-Raḥmān bin Abzā,from his father, from Ubayy binKa'b; that the Messenger of Allāhperformed the Qunūt in Witr beforegoing into Rukū'. Abū Dāwūd said: And like this, it was reported by 'Abdul-A'lā and Muḥammad bin Bishr Al-'Abdi — who heard it in Al-Kūfah along with 'Eisā bin Yunūs — and they did not mention the Qunūt, and it was also reported by Hishām Ad-Dastawā'i and Shu'bah from Qatādah, and they did not mention the Qunūt. Abū Dāwud said: As for the Hadīth of Zubaid; Sulaimān Al-A'mash, Shu'bah, 'Abdul-Malik bin Abī Sulaimān, and Jarīr bin Hāzim reported it, all of them from Zubaid, and none of them mentioned the Qunūt in it, except for what was related from Ḥafṣ bin Ghiyāth from Mis'ar, from Zubaid. For he said in his narration of it: "he performed the Qunūt before the Rukū'." Abū Dāwud said: And it is not popular from the narration of Ḥafṣ, we fear that it is really from Ḥafṣ from someone other than Mis'ar. Abū Dāwud said: It has been related that Ubayy would say the Qunūt during middle of Ramaḍān.

Commentary

It is to be noted that in Witr prayer, the Qunūt was said before Rukū' (bowing) but the Qunūt performed during the times of distress or calamity was said after the Rukū'.
