(قلت: إسناده ضعيف، قال المصنف عقبه: " هذا الحديث ضعيف، وهو موقوف على ابن عمر ". يعني: أن الصحيح وقفه عليه. لكن قد جاء معناه من حديث جابر مرفوعاً وهو في الكتاب الآخر (١٨١٣))

2079. It was reported from 'Abdullāh bin 'Umar, from Nāfi', from Ibn 'Umar, from the Prophet ﷺ that he said: "If a slave marries without the permission of his owner, his marriage is invalid." (Hasan) Abū Dāwūd said: This Hadīth is weak, rather, it is Mawqūf, and it is a statement of Ibn 'Umar.
2079 - حَدَّثَنَا عُقْبَةُ بْنُ مُكْرَمٍ، حَدَّثَنَا أَبُو قُتَيْبَةَ، عَنْ عَبْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «إِذَا نَكَحَ الْعَبْدُ بِغَيْرِ إِذْنِ مَوْلَاهُ فَنِكَاحُهُ بَاطِلٌ». قَالَ أَبُو دَاوُدَ: هَذَا الْحَدِيثُ ضَعِيفٌ وَهُوَ مَوْقُوفٌ وَهُوَ قَوْلُ ابْنِ عُمَرَ رَضِيَ اللَّهُ عَنْهُمَا
