2921. It was reported from 'Ikrimah, from Ibn 'Abbās, may Allāh be pleased with him, he said: (To those also with whom you have made a pledge (brotherhood), give them their due portion.)[1] A man would make an agreement with another man with no relationship between them, that they will inherit from one another. It was abrogated by (the following Verse of Sūrah) Al-Anfāl: "But kindred by blood are nearer to one another (regarding inheritance)."[2]
2921 - حَدَّثَنَا أَحْمَدُ بْنُ مُحَمَّدِ بْنِ ثَابِتٍ، حَدَّثَنِي عَلِيُّ بْنُ حُسَيْنٍ، عَنْ أَبِيهِ، عَنْ يَزِيدَ النَّحْوِيِّ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ رَضِيَ اللَّهُ عَنْهُمَا، قَالَ: (وَالَّذِينَ عَاقَدَتْ أَيْمَانُكُمْ فَآتُوهُمْ نَصِيبَهُمْ) " كَانَ الرَّجُلُ يُحَالِفُ الرَّجُلَ، لَيْسَ بَيْنَهُمَا نَسَبٌ، فَيَرِثُ أَحَدُهُمَا الْآخَرَ، فَنَسَخَ ذَلِكَ الْأَنْفَالُ، فَقَالَ تَعَالَى: {وَأُولُو الْأَرْحَامِ بَعْضُهُمْ أَوْلَى بِبَعْضٍ} [الأحزاب: 6] "
