English translation

2950. It was reported from Mālik bin Aws bin Al-Ḥadathān, who said: "One day 'Umar mentioned the Fai' and said: 'I am not more entitled to this Fai' than any of you, and none of us is more entitled to it than others, except that we are superior (to each other) based upon the Book of Allāh, the Mighty and Sublime, and the divisions made by the Messenger of Allāh ﷺ; so there is the man, and his precedence in accepting Islam; and the man, and his hardships, and the man; and his family, and the man; and his needs.”” (Da'if)

Commentary

The term Fai' is used in the Qur'an and Sunnah for spoils obtained without actual fighting. Ghanimah, on the other hand, refers to the spoils obtained after conquering the territory by fighting. Fai' is sometimes used to mean Ghanimah.
