English translation

4402. It was narrated from 'Aṭā' bin As-Sā'ib, from Abū Zabyān. Hannād (one of the narrators) said: “Al-Janbi.”[1] He said: “A woman who had committed fornication was brought to 'Umar, and he ordered that she be stoned. Then 'Ali, may Allāh be pleased with him, came by and he took her, and released her. 'Umar was told about that, and he said: 'Call 'Ali for me.' 'Ali, may Allāh be pleased with him, came and said: 'O Commander of the Believers, you know that the Messenger of Allāh ﷺ said: “The Pen has been lifted from three: From the child until he reaches puberty, from the sleeping person until he awakens, and from the lunatic until he comes to his senses.” This is the lunatic woman of Banū so-and-so, and perhaps the one who came to her (for intercourse) did so during one of her fits of lunacy.’ 'Umar said: 'I do not know.' 'Ali, may Allāh be pleased with him, said: 'I do not know either.’” (Da'if)

4402 - حَدَّثَنَا هَنَّادٌ، عَنْ أَبِي الْأَحْوَصِ، ح وحَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا جَرِيرٌ، الْمَعْنَى، عَنْ عَطَاءِ بْنِ السَّائِبِ، عَنْ أَبِي ظَبْيَانَ، قَالَ هَنَّادٌ الْجَنْبيُّ: قَالَ: أُتِيَ عُمَرُ بِامْرَأَةٍ قَدْ فَجَرَتْ، فَأَمَرَ بِرَجْمِهَا، فَمَرَّ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ، فَأَخَذَهَا فَخَلَّى سَبِيلَهَا، فَأُخْبِرَ عُمَرُ، قَالَ: ادْعُوا لِي عَلِيًّا، فَجَاءَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ، فَقَالَ: يَا أَمِيرَ الْمُؤْمِنِينَ، لَقَدْ عَلِمْتَ أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «رُفِعَ الْقَلَمُ عَنْ ثَلَاثَةٍ، عَنِ الصَّبِيِّ حَتَّى يَبْلُغَ، وَعَنِ النَّائِمِ حَتَّى يَسْتَيْقِظَ، وَعَنِ المَعْتُوهِ حَتَّى يَبْرَأَ»، وَإِنَّ هَذِهِ مَعْتُوهَةُ بَنِي فُلَانٍ، لَعَلَّ الَّذِي أَتَاهَا وَهِيَ فِي بَلَائِهَا، قَالَ: فَقَالَ عُمَرُ: لَا أَدْرِي، فَقَالَ عَلِيٌّ عَلَيْهِ السَّلَام، وَأَنَا لَا أَدْرِي
