English translation
4445. It was narrated from Abū Hurairah and Zaid bin Khālid Al-Juhānī that two men referred a dispute to the Messenger of Allāh ﷺ. One of them said: “O Messenger of Allāh, judge between us according to the Book of Allāh.” The other – who had more understanding – said: “Yes, O Messenger of Allāh, judge between us according to the Book of Allāh, and permit me to speak.” He said: “Speak.” He said: “My son was a hired servant of this man, and he committed Zinā with his wife. They told me that my son had to be stoned, but I ransomed him with one hundred sheep and a slave woman of mine. Then I asked the people of knowledge, and they told me that my son had to receive one hundred lashes and be banished for a year, and rather that his wife has to be stoned.” The Messenger of Allāh ﷺ said: “By the One in Whose Hand is my soul, I will judge between you according to the Book of Allāh. As for your sheep and slave woman, take them back.” And he gave his son one hundred lashes and banished him for a year, and he ordered Unais Al-Aslamī to go to the wife of the other man and if she admitted it, he was to stone her. She admitted it, so he stoned her. (Sāḥih)
