4459. It was narrated from Abū Bishr, from Khālid bin ‘Urfutāh, from Ḥabīb bin Sālim, from An-Nu‘mān bin Baṣhir, that the Prophet ﷺ said, concerning a man who had intercourse with his wife’s slave woman: “If she made herself lawful for him, he should be given one hundred lashes, and if she did not make herself lawful for him, then I will stone him.” (Hasan)
4459 - حَدَّثَنَا مُحَمَّدُ بْنُ بَشَّارٍ، حَدَّثَنَا مُحَمَّدُ بْنُ جَعْفَرٍ، عَنْ شُعْبَةَ، عَنْ أَبِي بِشْرٍ، عَنْ خَالِدِ بْنِ عُرْفُطَةَ، عَنْ حَبِيبِ بْنِ سَالِمٍ، عَنِ النُّعْمَانِ بْنِ بَشِيرٍ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، فِي الرَّجُلِ يَأْتِي جَارِيَةَ امْرَأَتِهِ، قَالَ: «إِنْ كَانَتْ أَحَلَّتْهَا لَهُ جُلِدَ مِائَةً، وَإِنْ لَمْ تَكُنْ أَحَلَّتْهَا لَهُ رَجَمْتُهُ»
