English translation

4460. It was narrated from Ma‘mar, from Qatādah, from Al-Ḥasan, from Qabiṣah bin Huraith, from Salamah bin Al-Muḥabbaq that the Messenger of Allāh ﷺ passed judgment concerning a man who had intercourse with his wife’s slave woman: If he forced her, then she would be set free and he would have to give her mistress another slave woman like her. If she obeyed him willingly, then she would belong to him, and he would have to give her mistress another slave woman like her. (Hasan) Abū Dāwūd said: A similar Hadīth was narrated by Yūnus bin 'Ubaid, 'Amr bin Dīnār, Maṇṣūr bin Zadhān and Salām, from Al-Ḥasan.
