English translation
4539. It was narrated (from Ḥammād and) Sufyān, and this is his version, from Tāwūs, who said: “Whoever is killed” – Ibn ‘Ubaid (one of the narrators) said: “He said: ‘The Messenger of Allāh ﷺ said’ –: “Whoever is killed, and the killer is not known, because he was killed when people were fighting and throwing stones, or hitting with whips and sticks, it is an accidental killing, and the Diyah is the Diyah for accidental killing. And whoever is killed deliberately, then it is retaliation. Whoever tries to prevent that (retaliation), then upon him is the curse and wrath of Allāh, and no Ṣarf nor ‘Adl’ will be accepted from him.”[2] And the Hadīth of Sufyān is more complete. (Saḥīh)
