3514. It was narrated from Abū Salamah bin ‘Abdur-Raḥmān, from Jābir bin ‘Abdullāh who said: “The Messenger of Allāh ﷺ enjoined pre-emption only in property that is not divided. If the boundaries have been fixed and the roads established, then there is no pre-emption.” (Sahih)
3514 - حَدَّثَنَا أَحْمَدُ بْنُ حَنْبَلٍ، حَدَّثَنَا عَبْدُ الرَّزَّاقِ، حَدَّثَنَا مَعْمَرٌ، عَنِ الزُّهْرِيِّ، عَنْ أَبِي سَلَمَةَ بْنِ عَبْدِ الرَّحْمَنِ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ: «إِنَّمَا جَعَلَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الشُّفْعَةَ فِي كُلِّ مَا لَمْ يُقْسَمْ، فَإِذَا وَقَعَتِ الْحُدُودُ وَصُرِّفَتِ الطُّرُقُ فَلَا شُفْعَةَ»
