3557. It was narrated from Tāriq Al-Makki, from Jābir bin 'Abdullāh, who said: "The Messenger of Allāh ﷺ passed judgment concerning an Anṣārī woman whose son gave her an orchard of palm trees, then she died, and her son said: 'I only gave it to her for as long as she lived,' and he had brothers. The Messenger of Allāh ﷺ said: 'It is for her in life and in death.' He said: 'I gave it in charity to her.' He said: 'That makes it even further away from you.'" (Da'if)
3557 - حَدَّثَنَا عُثْمَانُ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا مُعَاِويَةُ بْنُ هِشَامٍ، حَدَّثَنَا سُفْيَانُ، عَنْ حَبِيبٍ يَعْنِي ابْنَ أَبِي ثَابِتٍ، عَنْ حُمَيْدٍ الْأَعْرَجِ، عَنْ طَارِقٍ الْمَكِّيِّ، عَنْ جَابِرِ بْنِ عَبْدِ اللَّهِ، قَالَ: قَضَى رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فِي امْرَأَةٍ مِنَ الْأَنْصَارِ أَعْطَاهَا ابْنُهَا حَدِيقَةً مِنْ نَخْلٍ، فَمَاتَتْ، فَقَالَ ابْنُهَا: إِنَّمَا أَعْطَيْتُهَا حَيَاتَهَا وَلَهُ إِخْوَةٌ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «هِيَ لَهَا حَيَاتَهَا وَمَوْتَهَا»، قَالَ: كُنْتُ تَصَدَّقْتُ بِهَا عَلَيْهَا، قَالَ: «ذَلِكَ أَبْعَدُ لَكَ»
