English translation

4458. It was narrated from Qatādah, from Khālid bin 'Urfutāh, from Ḥabīb bin Sālim, that a man called 'Abdur-Rahmān bin Ḥunain had intercourse with his wife's slave woman. The case was referred to An-Nu'mān bin Bashīr, while he was the governor of Al-Kūfah, and he said: "I shall pass judgment concerning you as the Messenger of Allāh ﷺ passed judgment. If she made herself lawful for you, I shall give you one hundred lashes, and if she did not make herself lawful for you, I shall stone you.” They found that she had made herself lawful for him, so he gave him the punishment of one hundred lashes. (Hasan) Qatādah said: “I wrote to Ḥabīb bin Sālim, and he wrote back and told me this.
