4506. It was narrated from 'Amr bin Shu'aib from his father, from his grandfather that the Prophet ﷺ said: "No believer may be killed (in retaliation) for a disbeliever, and whoever kills a believer deliberately, he is to be handed over to the heirs of the victim. If they wish they may kill him, and if they wish they may accept the Diyah." (Hasan)
4506 - حَدَّثَنَا مُسْلِمٌ، حَدَّثَنَا مُحَمَّدُ بْنُ رَاشِدٍ، حَدَّثَنَا سُلَيْمَانُ بْنُ مُوسَى، عَنْ عَمْرِو بْنِ شُعَيْبٍ، عَنْ أَبِيهِ، عَنْ جَدِّهِ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، قَالَ: «لَا يُقْتَلُ مُؤْمِنٌ بِكَافِرٍ، وَمَنْ قَتَلَ مُؤْمِنًا مُتَعَمِّدًا، دُفِعَ إِلَى أَوْلِيَاءِ الْمَقْتُولِ، فَإِنْ شَاءُوا قَتَلُوهُ، وَإِنْ شَاءُوا أَخَذُوا الدِّيَةَ»
