[4397] 39 - (1683) It was narrated that Al-Miswar bin Makhramah said: "Umar bin Al-Khaṭṭāb consulted the people about Diyah for a woman's miscarriage. Al-Mughīrah bin Shu'bah said: 'I saw the Prophet ﷺ ruling that a slave, male or female, should be given.' Umar said: 'Bring me someone who can testify with you.' He (the narrator) said: 'Muhammad bin Maslamah testified with him.'"
39 - (1689) وحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، وَأَبُو كُرَيْبٍ، وَإِسْحَاقُ بْنُ إِبْرَاهِيمَ، وَاللَّفْظُ لِأَبِي بَكْرٍ، قَالَ إِسْحَاقُ: أَخْبَرَنَا، قَالَ: وَقَالَ الْآخَرَانِ: حَدَّثَنَا وَكِيعٌ، عَنْ هِشَامِ بْنِ عُرْوَةَ، عَنْ أَبِيهِ، عَنِ الْمِسْوَرِ بْنِ مَخْرَمَةَ، قَالَ: اسْتَشَارَ عُمَرُ بْنُ الْخَطَّابِ النَّاسَ فِي إِمْلَاصِ الْمَرْأَةِ، فَقَالَ الْمُغِيرَةُ بْنُ شُعْبَةَ: «شَهِدْتُ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى فِيهِ بِغُرَّةٍ عَبْدٍ أَوْ أَمَةٍ»، قَالَ: فَقَالَ عُمَرُ: ائْتِنِي بِمَنْ يَشْهَدُ مَعَكَ، قَالَ: فَشَهِدَ مُحَمَّدُ بْنُ مَسْلمَةَ
