English translation

3479. It was narrated that 'Aishah said: "I bought Barīrah and her masters stipulated that her Wala' should go to them. I mentioned that to the Prophet ﷺ and he said: 'Set her free, and Al-Wala' is to the one who pays the silver.' So I set her free and the Messenger of Allāh ﷺ called her and gave her the choice concerning her husband. She said: 'Even if you gave me such and such, I would not stay with him,' so she chose herself and her husband was a free man." (Sahīh)

Commentary

1. 'The one who pays' means the right of Al-Walâ' is for the one who buys and emancipates. 2. 'Her husband was a free man': These are not the words of 'Aishah, but Aswad, who is a successor (Tabi'i) and he was not present on the occasion. A manifest clarification has been transmitted from 'Aishah and Ibn 'Abbâs that he was a slave.
