English translation

4021. It was narrated that 'Abdullāh said: "The Messenger of Allâh ﷻ said: 'By the One besides Whom there is no other god, it is not permissible to shed the blood of a Muslim who bears witness to Lâ ilâha illallâh (there is none worthy of worship except Allâh) and that I am the Messenger of Allâh, except in three cases: One who leaves Islam and splits away from the Jamâ'ah,[1] a person who has been married and then commits adultery, and a life for a life.'" (Sahih) Al-A'mash said: "I narrated it to Ibrâhîm, and he narrated it to me from Al-Aswad, from 'Aishah, similarly."

Footnotes

  1. 1

    [1] Al-Furqān 25:68.

  2. 2

[2] Meaning, in No 4019, it is from Wāšil, from Abū Wā'il, from 'Abdullāh Ibn Mas'ūd. In No. 4020, Yazīd bin Hārūn narrated it; "Āšim, from Abū Wā'il..." and the mention of 'Āšim is incorrect according to the author.

Commentary

There is mention of shedding the blood of a Muslim in this Hadîth, meaning unlawfully. As for legal punishments, and fighting the rebs, this is a different matter.
