Text and translation

English translation

4625. It was narrated that Jâbir said: "A slave came and gave his pledge to the Messenger of Allâh ﷺ to emigrate, and the Prophet ﷺ did not realize that he was a slave. Then his master came looking for him. The Prophet ﷺ said: 'Sell him to me.' So he bought him for two black slaves, then he did not accept the pledge of anyone after that until he had asked: 'Is he a slave?'" (Sâhîh)

Commentary

In mutual sale and exchange of animals, increase and decrease is permissible. This is because some difference does generally often occur in the kind of animals. So to speak, they all are a distinct species, and when species or classes are different, increase and decrease is permissible. And it is clear, that the author has used this to prove the ruling for living creatures. See No. 4189 as well.
