English translation

1111. Jābir bin ‘Abdullāh narrated that the Prophet ﷺ said: “Whichever slave gets married without the permission of his owner, then he is a fornicator.” (Ḍa’if) (He said:) There is something on this topic from Ibn ‘Umar. (Abū ‘Eisā said:) The Ḥadīth of Jābir is a Ḥasan Ḥadīth. Some of them reported this Ḥadīth from ‘Abdullāh bin Muḥammad bin ‘Aqīl, from Ibn ‘Umar, from the Prophet ﷺ but it is not correct. What is Ṣaḥīḥ is from ‘Abdullāh bin Muḥammad bin ‘Aqīl, from Jābir bin ‘Abdullāh. This is acted upon according to the people of knowledge among the Companions of the Prophet ﷺ and others. The marriage of a slave without the permission of his owner is not allowed. This is the view of Aḥmad, Iṣḥāq and others (without any disagreement).

١١١١ - حَدَّثَنَا ‌عَلِيُّ بْنُ حُجْرٍ، قَالَ: أَخْبَرَنَا ‌الْوَلِيدُ بْنُ مُسْلِمٍ ، عَنْ ‌زُهَيْرِ بْنِ مُحَمَّدٍ، عَنْ ‌عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ ، عَنْ ‌جَابِرِ بْنِ عَبْدِ اللهِ ؛ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: «أَيُّمَا عَبْدٍ تَزَوَّجَ بِغَيْرِ إِذْنِ سَيِّدِهِ» فَهُوَ عَاهِرٌ. وَفِي الْبَابِ عَنِ ابْنِ عُمَرَ. حَدِيثُ جَابِرٍ حَدِيثٌ حَسَنٌ. وَرَوَى بَعْضُهُمْ هَذَا الْحَدِيثَ عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ عَنِ ابْنِ عُمَرَ عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَلَا يَصِحُّ، وَالصَّحِيحُ عَنْ عَبْدِ اللهِ بْنِ مُحَمَّدِ بْنِ عَقِيلٍ عَنْ جَابِرٍ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ أَنَّ نِكَاحَ الْعَبْدِ بِغَيْرِ إِذْنِ سَيِّدِهِ لَا يَجُوزُ، وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ وَغَيْرِهِمَا بِلَا اخْتِلَافٍ.
