١٣٤٥ - حَدَّثَنَا عَلِيُّ بْنُ حُجْرٍ، قَالَ: أَخْبَرَنَا إِسْمَاعِيلُ بْنُ جَعْفَرٍ، قَالَ: حَدَّثَنَا جَعْفَرُ بْنُ مُحَمَّدٍ ، عَنْ أَبِيهِ «أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ» قَالَ: وَقَضَى بِهَا عَلِيٌّ فِيكُمْ. وَهَذَا أَصَحُّ. وَهَكَذَا رَوَى سُفْيَانُ الثَّوْرِيُّ، عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مُرْسَلًا. وَرَوَى عَبْدُ الْعَزِيزِ بْنُ أَبِي سَلَمَةَ وَيَحْيَى بْنُ سُلَيْمٍ هَذَا الْحَدِيثَ عَنْ جَعْفَرِ بْنِ مُحَمَّدٍ، عَنْ أَبِيهِ، عَنْ عَلِيٍّ، عَنِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ؛ رَأَوْا أَنَّ الْيَمِينَ مَعَ الشَّاهِدِ الْوَاحِدِ جَائِزٌ فِي الْحُقُوقِ وَالْأَمْوَالِ. وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالشَّافِعِيِّ وَأَحْمَدَ وَإِسْحَاقَ، وَقَالُوا: لَا يُقْضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ إِلَّا فِي الْحُقُوقِ وَالْأَمْوَالِ. وَلَمْ يَرَ بَعْضُ أَهْلِ الْعِلْمِ مِنْ أَهْلِ الْكُوفَةِ وَغَيْرِهِمْ أَنْ يُقْضَى بِالْيَمِينِ مَعَ الشَّاهِدِ الْوَاحِدِ.

Commentary
There is a difference of opinion in the blood-money of a deliberate murder. According to 'Abdullāh bin 'Amr the blood-money of killing on purpose is thirty Hiqqah, thirty Jadha'ah and forty pregnant she camels. Imām Shāfi'i, Imām Muḥammad bin Al-Ḥasan, 'Aṭā, 'Umar, Zaid, Abū Mūsā and Muḡīrah have the same opinion. Imām Aḥmad's one opinion is also the same as mentioned above. Imām Zuḥri, Rabī'ah, Imām Mālik, Imām Abū Ḥanīfah and others have a different opinion. According to them blood-money of murder on purpose is twenty-five Bint Mukḥad, twenty-five Bint Labūn, twenty five Hiqqah, and twenty five Jadhā'ah. (Al-Mughnī v.12. p. 13.) This is also a notable second opinion of Imām Aḥmad.
