English translation
1383. Ibn 'Umar narrated: "The Prophet ﷺ made a deal with the people of Khaibar for half of what was produced from it, whether fruits or crops." (Sahih) (Another chain) with similar meaning.

١٣٨٣ - حَدَّثَنَا إِسْحَاقُ بْنُ مَنْصُورٍ، قَالَ: أَخْبَرَنَا يَحْيَى بْنُ سَعِيدٍ ، عَنْ عُبَيْدِ اللهِ ، عَنْ نَافِعٍ ، عَنِ ابْنِ عُمَرَ «أَنَّ النَّبِيَّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ عَامَلَ أَهْلَ خَيْبَرَ» بِشَطْرِ مَا يَخْرُجُ مِنْهَا مِنْ ثَمَرٍ أَوْ زَرْعٍ. وَفِي الْبَابِ عَنْ أَنَسٍ، وَابْنِ عَبَّاسٍ، وَزَيْدِ بْنِ ثَابِتٍ، وَجَابِرٍ. هَذَا حَدِيثٌ حَسَنٌ صَحِيحٌ. وَالْعَمَلُ عَلَى هَذَا عِنْدَ بَعْضِ أَهْلِ الْعِلْمِ مِنْ أَصْحَابِ النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ وَغَيْرِهِمْ، لَمْ يَرَوْا بِالْمُزَارَعَةِ بَأْسًا عَلَى النِّصْفِ وَالثُّلُثِ وَالرُّبُعِ. وَاخْتَارَ بَعْضُهُمْ أَنْ يَكُونَ الْبَذْرُ مِنْ رَبِّ الْأَرْضِ، وَهُوَ قَوْلُ أَحْمَدَ وَإِسْحَاقَ. وَكَرِهَ بَعْضُ أَهْلِ الْعِلْمِ الْمُزَارَعَةَ بِالثُّلُثِ وَالرُّبُعِ، وَلَمْ يَرَوْا بِمُسَاقَاةِ النَّخِيلِ بِالثُّلُثِ وَالرُّبُعِ بَأْسًا. وَهُوَ قَوْلُ مَالِكِ بْنِ أَنَسٍ وَالشَّافِعِيِّ. وَلَمْ يَرَ بَعْضُهُمْ أَنْ يَصِحَّ شَيْءٌ مِنَ الْمُزَارَعَةِ إِلَّا أَنْ يَسْتَأْجِرَ الْأَرْضَ بِالذَّهَبِ وَالْفِضَّةِ.

Commentary
Common things which are in common use of the community, and their availability is also abundant, such things like water, grass, waste land in use of people, should not be given as a grant to one person. If such things are given as a grant, it will create a problem for the people.
