English translation

2104. Āishah narrated that the Messenger of Allāh ﷺ said: "The maternal uncle inherits from the one who has no heirs." (Hasan) This Hadīth is Hasan Gharīb. Some of them narrated it in Mursal form, not mentioning 'Āishah in it. The Companions of the Prophet ﷺ differed regarding this. Some of them granted inheritance to the maternal uncle, maternal aunt, and the paternal aunt. Most of the people of knowledge followed this Hadīth regarding the inheritance of kin, while Zaid bin Thābit did not grant them inheritance, and he placed the inheritance in the Bait Al-Māl.
